The draft law, which amends Law no. 10\/1995 on construction quality and the Cadastre Law, <span style=\"text-decoration: underline\"><strong><span class=\"s1\">directly addresses the need to combat non-transparent commercial practices and the risk of developers failing to meet their obligations<\/span>.<\/strong><\/span><\/p><\/p><p class=\"p2 translation-block\"><p><span class=\"s2\">The most important novelty<\/span> <span style=\"text-decoration: underline\"><b>concerns the way developers manage the amounts received as advance payments (under pre-sale agreements<\/b><\/span><span class=\"s2\"><span style=\"text-decoration: underline\">)<\/span>:<\/span><\/p><\/p><ul class=\"ul1\"><li class=\"li3 translation-block\"><p><b>Dedicated Bank Account:<\/b> The amounts paid by the buyer as an advance must be deposited in a <b>bank account opened in the developer\u2019s name, dedicated exclusively to the construction of the project<\/b> for which the advance was paid.<\/p><\/li><li class=\"li3\"><b>Limitarea Cheltuirii (Plafon Ambiguu):<\/b> Fondurile din acest cont pot fi cheltuite de dezvoltator numai \u00een scopul dezvolt\u0103rii imobiliare a proiectului \u0219i doar cu \u0219tampila <b>\u201ebun de plat\u0103\u201d<\/b> a dirigintelui de \u0219antier sau a persoanei responsabile. Proiectul adoptat stabile\u0219te plafoane neclare de cheltuire:<br \/><ul class=\"ul1\"><li class=\"li3\"><b>Maxim 25%<\/b> din pre\u021b, pentru partea de <b>rezisten\u021b\u0103<\/b>.<\/li><li class=\"li3\"><b>Maxim 20%<\/b> din pre\u021b, pentru partea de <b>instala\u021bii<\/b>, dar numai dup\u0103 finalizarea structurii de rezisten\u021b\u0103.<\/li><\/ul><\/li><\/ul><p class=\"p4 translation-block\"><p>The formula adopted by the deputies is considered <span style=\"text-decoration: underline\"><strong><span class=\"s1\">ambiguous<\/span><\/strong><\/span>, differing from the Senate\u2019s original proposal, which included a <span style=\"text-decoration: underline\"><strong><span class=\"s1\">clearer cap on the total advance requested<\/span><\/strong><\/span>, staggered according to construction stages (15% at the preliminary agreement, 25% at structural completion, 25% at installation phase).<\/p><\/p><ul class=\"ul1\"><li class=\"li3 translation-block\"><p><b>Sanctions for Violations:<\/b> Using the advance payments for purposes other than real estate development triggers <b>fines amounting to 1% of the developer\u2019s turnover<\/b>.<\/p><\/li><\/ul><p class=\"p1\"><p>The draft introduces measures that ensure greater transparency and legal protection for buyers through real estate publicity:<\/p><\/p><ul class=\"ul1\"><li class=\"li3 translation-block\"><p><b>Promise to Sell (Pre-sale Agreement):<\/b> Pre-sale agreements for future residential units must be concluded <b>only in authenticated form<\/b> (before a notary).<\/p><\/li><li class=\"li3 translation-block\"><p><b>Registration in the Land Book:<\/b> These preliminary agreements may be concluded only after the <b>building permit is registered<\/b> in the Land Book.<\/p><\/li><li class=\"li3 translation-block\"><p><b>Pre-apartmentation:<\/b> The developer may promise the transfer of future individual units only <b>after completing the pre-apartmentation process<\/b> for the future condominium and <b>opening individual land book entries<\/b> for the future units.<\/p><\/li><li class=\"li3 translation-block\"><p><b>Preventing Multiple Sales:<\/b> Notaries will require the <b>registration of the pre-sale agreement in the Land Book<\/b>. This crucial measure prevents the sale of the same future apartment to multiple buyers simultaneously and ensures transparency regarding rights established over the property.<\/p><\/li><\/ul><p class=\"p1\"><p>Clear limits are also introduced for reservation agreements, which often precede pre-sale agreements:<\/p><\/p><ul class=\"ul1\"><li class=\"li3 translation-block\"><p><b>Limited Duration:<\/b> Reservation agreements may be concluded for a period of <b>maximum 60 days<\/b>.<\/p><\/li><li class=\"li3 translation-block\"><p><b>Reservation Cap:<\/b> The amount paid for the reservation <b>may not exceed 5% of the total sale price<\/b>, under penalty of <b>absolute nullity<\/b> of the agreement.<\/p><\/li><li class=\"li3 translation-block\"><p><b>Refund of the Amount:<\/b> If the pre-sale agreement is not concluded within 60 days due to the <b>exclusive fault of the developer<\/b>, the developer must <b>refund in full<\/b> the sums received under the reservation, within 30 days.<\/p><\/li><\/ul><p class=\"p1\"><p>Compared to the initial form adopted by the Senate, the Chamber of Deputies has removed important provisions that would have offered buyers stronger financial protection:<\/p><\/p><ul class=\"ul1\"><li class=\"li3 translation-block\"><p><b>Privileged Creditor Status:<\/b> The provision granting the state and the promissory buyer\/buyer the status of <b>privileged creditors in the developer\u2019s insolvency proceedings<\/b> has been removed. This elimination reduces the chances of buyers recovering their advances in the event of the developer\u2019s bankruptcy.<\/p><\/li><li class=\"li3 translation-block\"><p><b>Reduction of Notarial Fees:<\/b> The provision reducing notarial fees by 25% for buyers assisted by a lawyer when signing the pre-sale agreement or the sale contract has also been eliminated.<\/p><\/li><\/ul><h6 class=\"p2\"><b><p>These provisions are not yet in force.
