Stamp duty for partition (division) actions

Stamp duty court fee represents an essential procedural obligation in civil law, being due upon filing actions in court. Judicial partition, whether between former spouses or between heirs, has a patrimonial nature. Naturally, the value of the assets subject to division also influences the amount of the stamp duty court fee.

The default penalty interest related to compensation for damages caused by unlawful acts accrues from the date the damage occurred.

Prin Decision No. 3/2026, delivered in a public hearing on the date of 23 February 2026, the High Court of Cassation and Justice (HCCJ) admitted the appeal in the interest of the law concerning the regime for calculating the interest applicable to damages awarded to victims of unlawful acts, following a referral submitted by the Governing Board of the Bucharest Court of Appeal, thus putting an end to the inconsistent practice of the courts regarding the moment from which the default legal penalty interest begins to accrue.
