The High Court of Cassation and Justice decided today to refer the matter to the Constitutional Court of Romania (CCR) in connection with the new draft law on the reform of magistrates’ service pensions, which was published for public consultation in November by the Ministry of Labour and largely mirrors the same changes to retirement conditions proposed in the draft previously rejected by the CCR — namely, raising the retirement age to the standard applicable in the public system, reducing the pension amount to 55% of the calculation base, and capping the net pension at 70% of the last net income. The major difference compared to the earlier draft is the five-year increase in the transition period for those who reach 25 years of service between 2026 and 2041. The Government assumed responsibility on Tuesday for the new draft law before Parliament, with all previously submitted amendments being rejected.
